General Terms and Conditions Moving Smart & My Personal Training
Article 1 Applicability of the terms and conditions
These conditions apply if the participant has registered directly or indirectly with Moving Smart en- or Mijn Personal Training for following a Personal Training training program, or participates in a group lesson or other activities from the offer.
Article 2 Application, registration and placement
An Intake Form must be filled in completely and truthfully and signed and handed in or sent to you. As a result of the contents of the intake form, a participant can be refused participation in the fitness test or in other activities, without stating reasons.
Article 3 Invoicing
The amount stated on the agreement must be paid in cash, by direct debit or by bank transfer, within 14 days of the invoice date. It is not possible to pay the amount in installments unless otherwise agreed. In the event of late payment, the agreement may be dissolved by Moving Smart en- or Mijn Personal Training, the costs incurred by Moving Smart en- or Mijn Personal Training in connection with this will be borne by the participant/client.
Article 4 Training program
Moving Smart and My Personal Training are obliged, in view of the purpose of the training program, to guide the participant as best as possible during the times that the training is given by engaging a qualified trainer.
Article 5 Liability
1. Moving Smart and Mijn Personal Training is not liable if during a Personal Training or other activity, for whatever reason, items belonging to the participant and/or third parties are lost in any way.
2. Moving Smart and Min Personal Training is not liable if the participant suffers damage in any other way (physical or mental) and this damage is due to not following oral or written instructions.
3. Moving Smart and Mijn Personal Training is not liable if the participant suffers damage in any other way and this damage is due to incomplete or incorrect completion of the intake form and signed health declaration. Moving Smart and Mijn Personal Training are liable if the damage referred to above is the result of intent or gross negligence.
Article 6 Dissolution, cancellation and cancellation
Moving Smart and My Personal Training always work by appointment, which is agreed in consultation. You can cancel up to 48 hours before the agreed time of the relevant appointment. The training appointment can be made up at another time to be agreed within a period of 4 weeks. If the participant does not unsubscribe from a training appointment or part of it within 24 hours before the agreed time of the relevant appointment or for whatever reason does not go into the appointment, or part thereof, Moving Smart and- or Mijn Personal Training charge the costs owed, or do not deduct the costs owed. The relevant appointment cannot be rescheduled or overtaken by the participant.
Article 7 Rules of conduct when participating in the training
Without our prior permission, training appointments or part of the training appointments may not be followed by anyone other than the person who has registered with Moving Smart en- or Mijn Personal Training for the relevant appointments. The participant will always be present in time before the start of the training appointment and will follow the instructions of the Personal Trainer. The participant will adhere to the hygiene, clothing and footwear regulations to be given by Moving Smart and My Personal Training, if necessary.
Article 8 Disputes and applicable law
Dutch law applies to all agreements between Moving Smart and/or My Personal Training a counterparty. All disputes arising from or related to agreements between Moving Smart and/or Mijn Personal Training and a counterparty, to which these terms and conditions apply and which do not belong to the competence of the subdistrict court, will in the first instance be settled by the competent court. at the location of Moving Smart and- or My Personal Training. This clause does not affect the authority of Moving Smart and- or Mijn Personal Training to bring the dispute before the court that is competent according to the applicable normal rules of competence.

I collect the bank account number of the people who enter into a membership for a SEPA direct debit that takes place via Mollie. This primarily concerns your name, address, zip code + place of residence, telephone number, e-mail address, date of birth, bank account number, family situation, medication, your policy number and your health insurer, relevant medical history, whether you smoke, your profession, your objective with the guidance, the origin of your question and the current situation of your weight, any complaints, diet history and whether you exercise. In addition, I also collect data from anthropometric research, such as weight, BMI, fat and muscle percentage, waist circumference and your energy consumption. In the progress meetings I collect your experiences on the basis of which we can fine-tune or adjust the guidance. If this information is not provided or is not provided honestly, I cannot guarantee that I can give you good advice. At the end of your intake, I always ask whether you are sure that the data has been provided honestly and whether you want to sign for it. Via the online forms on the website and the newsletter, information is requested, such as name, e-mail address and telephone number, which are necessary to be able to process the requests.
Retention period
I keep your data on paper for a maximum of 2 years from the moment you last used my service. The data can be stored digitally for longer, because it also contains a lot of knowledge that I want to be able to consult again at a later time with another client, without having to research it again. If your data is stored, it is anonymised. In accordance with the law, financial data is kept for a minimum of 7 years and then deleted and possibly destroyed.
confidentiality
As also stated in the General Terms and Conditions, I and people who work at and- or with Moving Smart and Mijn Personal Training have a duty of confidentiality on the basis of which it is prohibited for me and people who work at and- or with Moving Smart and Mijn Personal Training to make announcements about you and your situation to others. I may only do this if there are valid reasons for sharing your data and if this is in the interest of my services or if I deem it necessary for your health.
View, change or delete
You can request access to the data that I have recorded about you at any time and have it changed or deleted.
